Terms and Conditions

These are the terms and conditions which apply when we supply products to you. These products could be physical goods, or services. Please read these terms carefully before you submit an order. These terms explain who we are, how we provide products to you, how the contract can be changed, and what to do if there is a problem.

 

Definitions

Rose Petal Cake Company Ltd – Referred to as “The Company”, “We”, “Us”, and “Our”. We have several trading names which are listed at the end of this document, but all relate to Rose Petal Cake Company Ltd.

The Person placing the booking, or any agent or person acting on behalf of a person placing a booking – Referred to as “You”,  and “The Client”. Any reference to “your” also includes You.

There are several sections within these terms, and only the section(s) relating to your booking will apply, as well as the General Terms section. If, for example, you have ordered a wedding cake and wedding catering, the “Wedding Cakes”, “Catering Services” and “General Terms” sections will apply.

General Terms - Applicable to ALL Products

 

  • These Terms and Conditions will always prevail, unless agreed otherwise in writing by us.
  • These Terms and Conditions are deemed to have been accepted when you confirm your booking, whether in writing, verbally or by paying any deposit/invoice.

  • Any complaints or claims relating to your booking must be received by us within 14 days of booking, or within 24 hours of the incident giving rise to the complaint/claim. A refund would only be due if the items are unsuitable for consumption. In this instance, the uneaten items must be returned to us for inspection within 24 hours. A refund will not be given if the items are not returned to us in this timeframe.

  • Payments must always be made by Bank Transfer, card or by cash. Cheques cannot be accepted.

  • These Terms and Conditions are subject to English Law and English Jurisdiction.

  • These Terms and Conditions do not affect any rights contained within the Unfair Contract Terms Act 1977, or any further modification to them. If any term is found to be unenforceable or unreasonable by a competent authority, the other terms will remain.

  • Any claims made under the Consumer Rights Act 2015 and the Consumer Contract Regulations 2013 only apply if you are not a business, or making a booking in relation to your occupation. If you are acting on behalf of a business, or making a booking in relation to your occupation, the Sale of Goods Act 1979 will apply.

  • We will not be liable to you, or deemed in breach of contract, for any delay in delivering or failure to deliver your booking if the reason for delay or failure is beyond our reasonable control. In this event, the most we will refund you is the total amount of your booking and no more.

  • It is your responsibility to ensure that all food (including cakes) and drink is displayed in a suitable manner/location. We do not accept any responsibility if issues arise due in improper placement or display.

  • If any amendments are made to your booking and this increases the price, payment for these amendments is due immediately. Amendments include (but are not limited to) change of location, change of design, and/or change of number of servings.

  • All allergens must be notified to us no later than 14 days in advance of your event date. We cannot be held responsible for ingredients that include allergens if you have failed to notify us. All food and drink items are made in a kitchen that handles allergens and therefore, we can never guarantee that any item is truly “free from”.

  • Due to availability of ingredients and the nature of bespoke items, some variations may occur. We will endeavour to match your designs exactly, but we cannot guarantee this. We may have to adjust your design in circumstances outside of our control, or if we feel that your design may compromise the quality of the finished cake.

  • By placing an order with Us, You agree that we can contact you in regard to the order You have placed.

  • We only sell products within the UK. Orders from outside the UK are accepted, but the delivery address must always be within the UK. Delivery distances within the UK are at our discretion due to other commitments and demands.

  • Any images of our products are for illustration purposes only, and the real product may vary due to being handmade. All sizes, weights, capacities, dimensions and measurements indicated will have a slight degree of tolerance to them.

  • Anyone wishing to cancel their order must do so in writing to our registered office address, or by email to rosepetalcakecompany@gmail.com. Any other form of cancellation will not be accepted.

 

Catering (at your premises or ours, with or without our Caterpod)

 

Deposits & Final Payments

  • 25% of the total cost of the booking is required within 7 days of confirming the order to secure the date. Without this, we will not hold the date and, in the event of other enquiries that share the same event date, priority will be given to the paying customer.

  • The remaining balance is due 8 weeks before the event date. 

 

How to make Payment

  • Payment by bank transfer is preferred.

  • Payments by card or cash can be arranged.

  • We will not be held responsible for any payments sent to the wrong bank account.

 

Refunds/Cancellations

  • The deposit is non-refundable and non-transferable under any circumstances due to the time already spent on your booking, plus any consultations or loss-of-business due to your booking preventing further bookings on the event date.

  • We retain the right to cancel bookings in very unusual circumstances beyond our control, such as fire or ill health, and we will in this instance refund any money taken in full.

Outside Events

  • We do not recommend any food/drink are displayed outside due to the risk of bacteria/insects/other contamination and therefore we accept no responsibility for any ill health, deformation or anything else that may occur if food/drink is placed outside.

  • We strongly recommend perishable food not to be stored out of the fridge for more than 2 hours. At this point, it must either be eaten, stored in a fridge or disposed of due to health and safety.

 

Collection & Delivery

  • Any delivery charges will be clearly quoted to you. If the venue is changed, additional charges may apply or your order may be cancelled if we are unable to deliver to your new venue (any refund will not include the deposit).

  • Damage in transit can occur, and where we cannot repair such damage, we will endeavour to substitute items for similar items where possible.

  • If any items are collected by you, we cannot be held liable for any damage in transit once the items have left our premises.

 

Responsibilities

  • It is your responsibility to read and check the quote thoroughly; any amendments should be made in writing. If requested we will endeavour to adjust the order contents where possible, but sometimes this is not possible due to the nature of the request or amount of notice given.

  • If the alteration affects the cost, or preparation work for the original order has already been undertaken, then your balance will be adjusted accordingly. Please warn us when you pay your deposit if you are undecided on the design.

  • We reserve the right to change the order/ menu at any point if circumstances beyond our control, for example if there are national food shortages.

 

Allergies & Special Dietary Requirements

  • Please discuss with us if any of your guests have special dietary requirements. Items can be made vegan, vegetarian, egg free, alcohol free, gluten free and dairy free by request. But please be aware items are made in a kitchen that uses all the above allergens as well as Nuts. Items can also be contaminated at the venue via other products, which we cannot control.

 

Best Before Date

  • Your items are made to ensure they are fresh for the date of your event. We cannot guarantee its quality if its consumed more than 2 hours after serving. Our items are made entirely of natural ingredients, so we’d like to remind you that because of this they will not have the extended shelf life of most supermarket food/drink, which contain additives/preservatives.

 

On-Site Requirements

  • If there is surplus product after your event, where it is possible for us to leave it with you, we will do so with your permission. If it is not possible, we will take the product away with us.

  • Unless your event is held at our premises, it is your responsibility to provide a suitable location for the preparation and serving of the products (the location must be clean, ready to use and free from any pets). We may also require access to and use of a fridge.

  • If your event requires use of our Caterpod Catering Trailer, it is your responsibility to ensure a suitable, off-road, location where we can park it for the duration of your event and at least one hour either side of the start and end time. A suitable off-road location is defined as an area big enough to park a large SUV, on land not publicly accessible (such as a private home driveway). If we attend and find that you do not have a suitable off-road parking location, we will not be able to fulfil your booking and you will be charged. We cannot legally park on the road for your event, as this requires licensing by the council. Unless agreed otherwise, you must supply a suitable point for power (either a standard UK plug socket or a female 16 amp connector) that is no more than 20 metres from the parking area. If we have to use our generator, we will place it in a location away from your guests and our Caterpod where possible. Any fuel costs will be passed onto you and we will not be liable for any noise complaints made.

 

Wedding Cakes & Celebration Cakkes

Wedding Deposits and Final Payments

  • A £75 non-refundable deposit is required within one week to secure your order. Without the deposit, we will not hold the date. Priority will be given to the paying customer. The final payment is due 8 weeks before the event date. If the final payment is not received then your wedding cake will not be made.


Non-Wedding Cake Deposits and Final Payments

  • A 50% (of your order) non-refundable deposit is required within one week of booking to secure your order. Without the deposit, we will not hold the date. Priority will be given to the paying customer. The final payment is due on collection/ delivery of your cake(s). If the final payment is not received then your cake will not be released to you.

  • We retain the right to cancel bookings in very unusual circumstances beyond our control, such as fire or ill health, and we will in this instance refund any money taken in full.

  • As our cakes are made to order and personalised to suit your requirements, orders cannot be cancelled once the cake has been made. However, should you wish to change your order please contact us in writing immediately and we will do our best to meet your needs.

  • We retain the right to cancel bookings in very unusual circumstances beyond our control, such as fire or ill health, and we will in this instance refund any money taken in full.

  • As our cakes are made to order and personalised to suit your requirements, orders cannot be cancelled once the cake has been made. However, should you wish to change your order please contact us in writing immediately and we will do our best to meet your needs.

Outside Events

  • Any cake(s) placed outside during an event has the possibility of melting or deforming due to the heat. We are not liable in any way for damage to cakes once they have been delivered/collected.


Cake Location

  • It is the responsibility of the customer to ensure the venue supply a suitable table and location for the cake(s) to be displayed. Once again, we are not liable in any way for the cakes once delivered or collected.

 

Delivery of Cakes

  • The cost of delivery will be made clear in the price quoted. If the venue is changed and of a further distance, additional charges may apply. Although care is taken when transporting your cake, damages in transit can happen. We carry special cake repair kits for circumstances where damage may occur. All cakes will be repaired at the venue to as close to the original design as possible. We cannot be held liable for any damage that is rendered to the cake at the venue once we have left the premises. It is with this in mind that we require somebody responsible, to check that they are happy with the cake before we leave.

 

Collection of Cakes

  • On collection of cakes, we are not liable or responsible once the cake has left our premises. You should ensure your vehicle is clean and tidy before collection, cakes should be placed in the boot on a non-slip mat. We do everything in our power to provide a well-structured cake, but please note, cakes can be very fragile so you must drive with reasonable care.

 

Design and Alterations

  • It is your responsibility to read and check the quote thoroughly; any amendments should be made in writing. If requested we will endeavour to adjust the design were possible, but sometimes this is not possible due to the nature of the request or amount of notice given. If the alteration affects the cost, or preparation work for the original design has already been undertaken, then your balance will be adjusted accordingly. Please warn us when you pay your deposit if you are undecided on the design. We reserve the right to change the design at any point if circumstances beyond our control, may compromise the quality of the finished cake e.g. melting due to weather. Each cake is made individually by hand, so although every effort is made to ensure consistency, a small amount of variation may occur. Any cake ordered from a picture created by another cake maker can only be reproduced by Rose Petal Cake Company as our interpretation of the cake, and will not be an exact replica of the cake in the photograph. Rose Petal Cake Company are happy to use photographs for cakes as inspiration for designs but cannot guarantee an exact design match.

Allergies and Special Dietary Requirements

  • Please discuss with us if any of your guests have special dietary requirements. Cakes can be made egg free, alcohol free, gluten free and dairy free by request. But please be aware cakes are cooked in a kitchen that uses all of the above ingredients as well as Nuts. Cakes can also be contaminated at the venue via other products, which we cannot control.


Non-Edible Items

  • Most cakes contain small proportions of inedible items, it is the client’s responsibility to ensure these are removed by your caterer/guests before consumption e.g. support dowels in tiered cakes, ribbon, wires in sugar flowers. We will show the responsible person where any non-edible items are on the cake before we leave the premises or before you collect the cake.


Best Before Date

  • Your cake is baked to ensure it is fresh for the date of your event. We cannot guarantee its quality if its consumed more than 48 hours after the event. Our cakes are made entirely of natural ingredients, so we’d like to remind you that because of this they will not have the extended shelf life of most supermarket cakes, which contain additives/preservatives.

Computer Viruses

We do not guarantee that our website will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform in order to access our site. You should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored, or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities, and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
