Terms and Conditions

These are the terms and conditions on which we supply products to you, whether these are goods, services or digital content. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information.

Celebration and Wedding Orders

For wedding bookings and afternoon tea bookings - A £50 non-refundable deposit is required within one week to secure your order. Without the deposit, we will not hold the date. Priority will be given to the paying customer. The final payment is due 4 weeks before the event date. If the final payment is not received then your wedding cake/afternoon tea will not be made.

For celebration cakes - A 50% non-refundable deposit is required within two weeks to secure the order. Without the deposit, we will not hold the date. Priority will be given to the paying customer. The final payment is due on collection/ delivery of the cake. If the final payment is not received then your cake will not be released to you. 

 

Payment can be made via bank transfer or cash.

The initial deposit is non-refundable and non-transferable under any circumstances due to time already spent on consultation and any loss of business due to your booking preventing further bookings on that date. We retain the right to cancel bookings in very unusual circumstances beyond our control, such as fire or ill health, and we will in this instance refund any money taken in full.

For non-wedding cakes: As our cakes are made to order and personalised to suit your requirements, orders cannot be cancelled once the cake has been made. However, should you wish to change your order please contact us in writing immediately and we will do our best to meet your needs. There will be no refund for cakes cancelled less than five days before collection/delivery.

For wedding cakes: there will be a 10% charge for orders cancelled more than 60 days before the event, 50% charge for orders cancelled 31-59 days before the event, and 100% charge for orders cancelled 30 days or less before the event.

Any cake(s) placed outside during an event has the possibility of melting or deforming due to the heat. We are not liable in any way for damage to cakes once they have been delivered/collected.

It is the responsibility of the customer to ensure the venue supply a suitable table and location for the cake(s) to be displayed. Once again, we are not liable in any way for the cakes once delivered or collected.

The cost of delivery will be made clear in the price quoted. If the venue is changed and of a further distance, additional charges may apply. Although care is taken when transporting your cake, damages in transit can occur. We carry special cake repair kits for circumstances where damage may occur. All cakes will be repaired at the venue to as close to the original design as possible. We cannot be held liable for any damage that is rendered to the cake at the venue once we have left the premises. It is with this in mind that we require somebody responsible, to check that they are happy with the cake before we leave.

On collection of cakes, we are not liable or responsible once the cake has left our premises. You should ensure your vehicle is clean and tidy before collection, cakes should be placed in the boot on a non-slip mat. We do everything in our power to provide a well-structured cake, but please note, cakes can be very fragile so you must drive with reasonable care.

It is your responsibility to read and check the quote thoroughly; any amendments should be made in writing. If requested we will endeavour to adjust the design were possible, but sometimes this is not possible due to the nature of the request or amount of notice given. If the alteration affects the cost, or preparation work for the original design has already been undertaken, then your balance will be adjusted accordingly. Please warn us when you pay your deposit if you are undecided on the design. We reserve the right to change the design at any point if circumstances beyond our control, may compromise the quality of the finished cake e.g. melting due to weather. Each cake is made individually by hand, so although every effort is made to ensure consistency, a small amount of variation may occur. Any cake ordered from a picture created by another cake maker can only be reproduced by Rose Petal Cake Company as our interpretation of the cake, and will not be an exact replica of the cake in the photograph. Rose Petal Cake Company are happy to use photographs for cakes as inspiration for designs but cannot guarantee an exact design match.

Please discuss with us if any of your guests have special dietary requirements. Cakes can be made egg free, alcohol free, gluten free and dairy free by request. But please be aware cakes are cooked in a kitchen that uses all of the above ingredients as well as Nuts. Cakes can also be contaminated at the venue via other products, which we cannot control.

​

Most cakes contain small proportions of inedible items, it is the client’s responsibility to ensure these are removed by your caterer/guests before consumption e.g. support dowels in tiered cakes, ribbon, wires in sugar flowers. We will show the responsible person where any non-edible items are on the cake before we leave the premises or before you collect the cake.

Your cake is baked to ensure it is fresh for the date of your event. We cannot guarantee its quality if its consumed more than 48 hours after the event. Our cakes are made entirely of natural ingredients, so we’d like to remind you that because of this they will not have the extended shelf life of most supermarket cakes, which contain additives/preservatives.

Cakes must never be left in direct sunlight, hot and/or humid conditions nor should the cake be stored in a fridge. Rose Petal Cake Company cannot be held responsible for any damage caused to the cake(s) once delivered or collected from our studio.

Cakes need to be cut with care, particularly fruit cakes and carrot cakes which can crumble if not handled correctly. Use a long-handled sharp serrated knife – ornamental knifes used for photographs are generally not suitable for cutting the cake. Please note that some cakes contain internal supports and will be supported by non-toxic foil cake cards. We can provide cake cutting guides, please let us know at the time of order if you would like these to be provided.

For wedding cakes, once the cake has been set-up at the venue, and the cake has been signed for, Rose Petal Cake Company does not take any responsibility for any damage to the cake from the fresh flowers, or the placement on the cake of the fresh flowers. If fresh flowers are supplied by an external supplier, Rose Petal Cake Company cannot be held responsible. You acknowledge that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants. It is the customer’s responsibility to ensure that any fresh flowers displayed on or next to the cake do not contain pesticides and are food-safe (non-toxic).  Rose Petal Cake Company can take no responsibility for the flowers being food-safe.

Please note if real flowers are being added to the cake then it must be noted that water residue can sometimes affect the surface of the icing or cake surface. Rose Petal Cake Company cannot be held responsible.

If you have concerns about your cake please notify us upon collection/delivery so that we have the opportunity to rectify it in time for your event. All other concerns should be made in writing within 24 hours, and evidence of the fault should be included. A refund is only given if the cake is unsuitable for consumption or not as described in the written quote. In this instance, the uneaten cake must be returned to Rose Petal Cake Company for inspection before a refund is issued. No refunds are given due to change of mind.

Online Shop Orders:

The acceptance of your order will take place when we email you to accept it, 

If we cannot accept your order: If we are unable to accept your order, we will inform you of this either by email and we will not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.

Your order number: We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.

We only sell to the UK: Our website is solely for the promotion of our products in the UK. Unfortunately, we do not accept orders from or deliver to addresses outside the UK. Delivery distances within the UK are at our discretion due to other commitments and demands.

Products may vary slightly from their pictures,  The images of the products on our website are for illustrative purposes only. Your product may vary slightly from those images. Although we have made every effort to be as accurate as possible, because our products are handmade, all sizes, weights, capacities, dimensions and measurements indicated on our website have a slight degree of tolerance to them.

If you wish to change the product you have ordered, please contact us immediately. We will let you know whether the change is possible. If it is possible we will let you know about any changes to the price of the product, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.

Viruses

We do not guarantee that our site will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform in order to access our site. You should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
